I was wondering what rules the SimplePlanes site has about the copyright claims on others taking stuff made here. The reason I ask is because someone was downloading these planes here and selling them 3d printed a while back, but I just recently noticed this while doing some research on planes: COPYRIGHT
This dude stole SimplyPlain's XB-52 LRHBA build for their site, and correct me if I am wrong, but this douchecanoe did not cite the sources for the images, which means they effectively stole their creation without their consent
So, in Layman's terms what I am asking is, are our builds protected under any copyright laws?
This has happened before.
In this case, we use United States copyright law, since this is the most well known, apart from other copyright laws.
.
United States Copyright law is confusing, therefore my opinions cannot guarantee support from lawyers, in which I am not part of.
.
If a creation is original and creative, then it is automatically copyrighted. This image fits the criteria and the person using it in an unauthorized manner may have committed copyright infringement, however ownership is dubious as screenshots of games infringes the copyrights of the one who made said game (e.g. Jundroo).
.
Most original code is copyrighted, however wether the successors are copyright infringement is dubious as while the rules state that successors are allowed, the Terms Of Use does not state wether it is eligible or not. It may be possible to add licenses as comments in the plane files, though I have not tested it. In the case of this one incident, wether it is copyright infringement or not is dubious, as in the case of this one, the ruling that a derivative sculpture is infringing is based because it is an infringing, non-fair use derivative of the original work. There are several sources, like the one that deals with rendering 3D models in one render sold to the public, and another case if one can render another’s work as a 3D model legally.
.
In one incident, Jundroo reportedly has filed a takedown to a person who has used our builds for his 3D models as copyright infringement.
.
On the other hand, there are more permissive websites that use various licenses. Images of pixel scale ships found in one site are licensed under CC-BY-NC, allowing literally everyone to use and remix those images, as long as they credit the original author, and not make any commercial use out of them. Wikimedia Commons has most images under CC-BY-SA, which is the same like CC-BY-NC, but while commercial use is allowed, you must post the image’s remixes, derivatives, etc under the same license.
.
Please ask a lawyer for more information.
@Typhoon03 yeah. I just went to that forum page you linked. Funny thing is, the second image was one of my builds.
This made me think of something, where is the TOS? There's a link to the privacy policy on the bottom of the site but nothing stating the terms of service.
Update: Apparently you get a link to it when first registering an account. Still weird that you can't see it anywhere else tho.
@Bellcat huh. That is very true, thank you mate
.
It was probably an error on their part, as @ReinMcDeer stated, but they should have at least cited it, because no matter what it is obviously not a historic drawing or a real picture, so they should have checked. But oh, well
Idk, but my guess is he looked up Convair XB-52 in Google and picked whatever images he could find.
He probably didn't realize it was SP.
Either way, not cool.
@FeatherWing yeahhh... I understand. It just sucks rather it's so easily taken from great builders
.
Thanks!
I wouldn't think so as they are only images, but I'm not an expert on Jundroo's Copyright rules, so I'll let someone who knows for definite answer this properly.
