Introduction
This is a fairly simple, direct document, meant to remove any chance of future tyranny in what was once North Korea and part of China.
Sections
1.Removal of an executive branch, we will have a government that has three branches . . . however we will remove the executive branch, as it gives to great a power for very few to hold. Instead we will have the Regional Vote.
2.Establishing of Pyongyang Council, the top legislative group is the Pyongyang Council. Their primary role is to weigh on decisions made by the lower parliaments and write in laws. They also have the ability to amend the constitution if necessary.
3.Judaical branch, this is made up of both the Federal Judiciary and Regional Courts. They can vote on laws, reject or support lesser courts rulings, and remove council of legislative body members.
4.Regional Council, this lesser parliament resolves regional disputes, writes some legislation, and votes on decisions made by the other 2 balances.
LAWS
1.Any unmentioned law is left up to the Region.
2.Murder, Violent attacks, Terrorism, Hijackings, Espionage, Assault, and Hate Crimes are all violent felonies, that both must go through higher courts and demand stricter sentencing. Notes-Rape is considered a assault
3.Minor Offenses are interpreted by the local governments. These include; manslaughter, accidental wrecks, DUIs, drug charges, some domestic violations, tickets, petty theft, theft, larson, etc.
Notes-Marijuana and Alcohol are taxed and sold to anyone over 25.
Rights
1.(Same as American)Freedom of speech, as long as it is not slanderous or threatening. Freedom to assemble peacefully, to worship as you see fit, and a lack of censorship.
2.Freedom from strange or sick punishment, this includes the guilty by relation, or 2 generation imprisonment.
3.The right to elect and remove leaders into/from positions of power.
4.The right to civil and social aid, to a reasonable extent.
5.The right to an education, no matter the circumstances . . . this doesn't apply to private schools.
6.The ability to own fire arms, to a reasonable degree. This is up to interpretation by the Regions.
7.Freedom to marry/love whom ever you want.
8.Right to an attorney in court, if necessary one will be provided.
9.Right to trial by a jury from the same region.
10.Safety from the military, the army cannot be used against our citizens . . . IE:YOU.
`11. Warrants are necessary for arrests and searches.
`12.A maximum of 10% of the GDP can go to defense or military projects. This is not a concern during war time.
`13.Roads must, sewers must, electrical grids must, and gas and water lines must all be properly maintained and inspected.
